Manufacturing defects, such as those found in the 3M defective earplug litigation, can be the cause of a defective product or “product liability” lawsuit. It is the most common type of product liability lawsuit. A “product liability” lawsuit is one that alleges that a defective product injured or killed someone. The other two types of product liability lawsuits are design defect and marketing defect cases.
An example of a “manufacturing defect” lawsuit would be a child’s safety seat in a car that was designed properly but was manufactured in a careless manner. For example, having a restraint that did not work because of a faulty clasp. A manufacturing defect lawsuit can result from a product that was manufactured too quickly or without proper safeguards.
